I have been with my partner for 14 years and we have been buying the house for the last 4 years. Unfortunately were on the verge of seperating, I lost my job 10 months ago so my partner is the sole wage earner and we have a young son of 8 who has special needs. I need to know were I stand in this, what I need to do and any legal advice I should need?
If the property is in your joint names then you both have a joint and individual liability to ensure that the mortgage payments are made on time and if not then you can both be pursued for any loss that your Lender may make on the sale of your property. One of your priorities should be to make sure that payments are made until your situation is sorted out.
