Mortgage Responsibilities

Posted on 19 April 2010 by shane muddell

I have lived in the property for 12 yrs approx and bought it approx 7 yrs ago joint with common law wife...where do I stand on moving out, do I have to pay full mortgage or half?

Shane

Any mortgage held in joint names is a joint and several responsibility. This means that you both have an individual responsibility to make sure the mortgage is paid in full each month as well as a joint responsibility. It also means that if payments are not maintained then the Lender can pursue either one or both of you for all the outstanding payments or ultimately the whole mortgage debt.

I recommend that you seek independent legal advice about your situation.
