I split up with my partner 3 years ago, the house has been up for sale since then, we have a joint mortgage on the property, she moved out when we split up. Does she have to pay half the mortgage from the date of separation? The property is in Scotland.
Your mortgage is a joint and several responsibility which means that you are both bound by the mortgage covenants you gave when you took out the mortgage, regardless of who is living in the property.
I recommend that you let your lender know and take independent legal advice regarding the situation you are now in.
