Can my ex have two mortgages?

Posted on 10 December 2011 by Jill

I have a joint mortgage with my ex husband, when we divorced he paid the repayments as we had remortgaged the house and he took £40.000 and I had £10.000 plus we have 2 children and he said he would pay instead of child support. He stopped paying about 3 years ago as he said he no longer wanted anything to do with the house. We had arrears on the mortgage because he just stopped payments. I have paid these and am paying the mortgage myself. I have tried to get him to pay back something into the house but he won't and now he has just brought a house with his new wife.   I didnt think it was possible to get another mortgage?

Depending on the size of each mortgage and your ex husband's income it is possible to be named on 2 mortgages and you may have done him a huge favour in clearing the mortgage arrears and maintaining the monthly payments since then.

I have referred your enquiry to our in house solicitors, Rollingson's to see if there is anything you can do to get him to contribute to your mortgage costs.
